Law Without Compassion Becomes Tyranny, Compassion Without Law Becomes Anarchy: CJI

Digital Desk, New Delhi. Chief Justice Surya Kant on Sunday said that law without compassion becomes tyranny and compassion without law leads to anarchy.

Addressing the concluding ceremony of the 30-day special awareness campaign of the Goa State Legal Services Authority on drug abuse, the CJI said that we should understand that drug abuse is not just a criminal problem. This is also a social, psychological and medical problem, to deal with which steps like counseling are needed and not retaliatory statements.

He said that this month-long campaign on drug abuse has been successful in clearly reflecting this sentiment. I would also like to talk about the important interrelationship between the legal system and social change. Over the last four decades, I have seen the evolution of our justice system. I see it as recognizing that law without compassion becomes tyranny and compassion without law creates anarchy.

The Chief Justice said that the problem of addiction does not come with noise or warning. It silently enters our homes, classrooms and communities and saps a future full of possibilities. Drug abuse not only ruins individuals but also ruins the society.

Justice is a living institution, which must maintain balance

Chief Justice Surya Kant on Sunday said justice is a living institution, which must maintain a balance between continuity and change. Addressing the valedictory function of the International Law Conference organized by the Supreme Court Advocates on Record Association, the Chief Justice stressed that the law should neither resist change nor adopt new things without thinking. A law that does not accept change is no longer pure.

At the same time, a law that adopts every new thing without thinking also runs the risk of losing its moral authority. Every legal system is the legacy of centuries of struggle, debate, compromise and moral courage.

The question will always remain how justice can hold on to its core principles in a world that never stands still. It is this curiosity that leads me to the theme of justice, which stands the test of time, tested by change and sustained by the collective discipline of those who serve.
