High Court Angry Over The Arbitrariness Of UP Police, Lucknow Bench Takes Tough Stance On Illegal Detention Of Sister Of Theft Accused

Unnao police are in the dock for illegally extorting the sister, mother and father of the accused of cash and jewelery theft from the house of Shiv Jaiswal, a resident of Dariyakheda in Sadar area, to the police station in the name of interrogation and keeping them in lockup overnight. Lucknow bench of Allahabad High Court has taken a tough stance on the petition of the accused's sister Ruby Singh and has ordered the Chief Secretary of the state to file a personal affidavit within three weeks or appear in person for the next hearing on January 29, 2026. This order has been passed by the division bench of Justice Abdul Moin and Justice Babita Rani during the hearing of the petition.

Shiv Jaiswal, resident of Khaira Beej Kunku of Barabanki district, currently lives in Kabbakheda Dariyakheda locality of Unnao Sadar area. On August 5, 2025, he had filed a complaint against Sachin, Sandeep and Rajendri, residents of Loknagar Mohalla, in the Sadar police station, saying that they had given the work of installing tiles in the house to contractors Sandeep and Sachin. Both worked between July 14, 2025 and July 28. On August 3, 2025, he was preparing to go to his village Khaira. When I went to collect jewelery from the cupboard, Rs 10,000 and jewelery worth lakhs were missing.

On being suspicious, when Sandeep interrogated the contractor, he admitted to the theft and said that Sachin was also involved in it. Sandeep also told that he has sold some items while other jewelery is with his mother Rajendri. Based on Shiv Jaiswal's complaint, the police registered a report on August 7 and started investigation. Sandeep's sister Ruby Singh filed a petition in the Lucknow High Court bench in the same case, alleging that the Kotwali police mentally tortured her during interrogation between August 5 and 8.

Illegally kept in lockup at night on the night of 7th August 2025. Police personnel harassed him by making indecent remarks. His mother Rajendri and brother Sandeep were also kept in the police station for questioning. Not only this, cash and mobile phones were confiscated. Two people of the house were released after taking Rs 10,000. Ruby Singh said that the truth should be seen by getting the footage from the cameras installed in the police station from August 5 to August 8.

By filing a personal affidavit before the court on behalf of Unnao SP, it was accepted that there was a conversation related to money between the petitioner and the police personnel but the fact of taking money was not proved. Due to the behavior of the constables being against the police conduct, on December 17, 2025, the SP put the police personnel Sanjay Bhathi and Arpit in line and conducted a preliminary inquiry. The court has described the action against the police personnel as light and careless.

Court expressed displeasure over not providing footage

On behalf of the state government, it was said that the footage of CC cameras from August 5 to August 8, 2025 is not available. Presented the fact that according to the DGP's circular dated June 20, 2025, the footage remains safe only for two to two and a half months. On this, the court said that this circular is contrary to the Supreme Court order of December 2, 2020 (Paramveer Singh Saini vs. Baljit Singh), in which it has been made clear that the footage of CC cameras of police stations should be preserved for at least six months. The court has prima facie considered this circular of the DGP as a violation of the order of the Supreme Court. It also said that calling a woman anywhere other than her place of residence is prohibited. Despite this, calling the petitioner woman to the police station is a violation of the law.

They have been sent to jail

After registering a report on the complaint of Shiv Jaiswal, the police sent Sachin and petitioner Ruby's mother Rajendri to jail after recovering the stolen goods. Sandeep's sister Ruby had filed a petition in the Lucknow High Court bench accusing the police of harassment.

The order of the High Court will be followed. According to the budget received for cameras in the past, cameras were installed in police stations and police stations across the state. Now the budget has been released again. Soon such DVR sets will be installed in which recordings can be preserved for six months or more. Jaiprakash Singh, SP
