High Court Imposed Conditional Fine Of Rs 50 Thousand On Himachal Government, Took Action In Shimla Municipal Corporation Mayor Case

Himachal Pradesh High Court has imposed a conditional fine of Rs 50,000 on the state government in the case related to extending the tenure of the Mayor of Shimla Municipal Corporation. The court imposed this penalty on the government for not filing its reply on time and has also issued a notice to the Urban Development Department. A division bench of Chief Justice GS Sandhwalia and Justice Zia Lal Bhardwaj observed that the reply filed by the state government is still under objections and has not been filed again.

Instructions to bring the reply on record within two days

In such a situation, the court has directed the government to remove the objections within two days and bring the reply on record, so that the hearing on the petition can be completed. This matter is related to the ordinance brought to extend the tenure of the Mayor of Shimla Municipal Corporation from two and a half to five years.

What did the petitioner's lawyer say?

Petitioner's advocate Sudhir Thakur said that the state government had brought an ordinance in this regard and sent it to the Governor for approval, but the Governor has not yet given his consent to it. The petition also said that this ordinance is against Section 36 of the Himachal Pradesh Municipal Corporation Act and the prescribed roster.

The court has fixed the next hearing of the case on 24 February 2026. Also, instructions have been given that the state government should also file a status report during the interim period, because it has been argued that the period of the concerned ordinance is about to expire.
