State Bureau, Ranchi. According to PESA rules, Gram Sabha will be the most powerful unit. Before the special meeting, a copy of it will be pasted at public places in the concerned Gram Panchayat and information will be given by making announcement by beating drums in the Gram Sabha area. In case the post of Gram Sabha President becomes vacant, it will be mandatory to conduct election of the President within a month.
If the post becomes vacant due to death/resignation of the post of the President or any other reason, as per the tradition and custom, the election/nomination of the new Gram Sabha President will be done within one month of the date of vacancy.
For the selection/nomination of a new president, it will be mandatory to provide this information in writing to the Block Development Officer-cum-Secretary Panchayat Samiti/Deputy Development Commissioner-cum-Chief Executive Officer, District Council and District Magistrate/Deputy Commissioner within 10 days.
Assistant Secretary of Gram Sabha will be appointed for one year
According to the rules, the Gram Sabha will be able to elect an Assistant Secretary from among its members or the Gram Sabha can take the help of a previously selected Panchayat Assistant as Assistant Secretary.
The Gram Sabha will be able to determine the duties of the Assistant Secretary as per its requirement. Such Assistant Secretary will discharge his duties. According to the rules, the Assistant Secretary of the Gram Sabha can be appointed for one year, but he will be eligible for re-appointment. Women should be given priority while selecting the Assistant Secretary by the Gram Sabha.
It is possible to remove the Assistant Secretary at any time by majority vote.
According to the rules, if the Secretary of the concerned Gram Panchayat does not follow the orders of the Chairman of the Gram Sabha meeting, which fall within the functions of the Panchayat Secretary in order to discharge or implement the responsibilities under the Jharkhand Panchayati Raj Act 2001, then the Chairman can expect the executive officer of the concerned Panchayat Committee to control him.
On the other hand, if the State Government, at its discretion, investigates the activities of the Panchayat, then the Chairman can make a written request to the investigating officer seeking resolution of the problems and can state that there are certain obstacles in the performance of his duties, which are creating problems in carrying out the work in accordance with the objectives of the Jharkhand Panchayati Raj Act 2001.
After this, the said officer will be able to give instructions to execute all such related work, which is not being done by the Panchayat and which is necessary to be done in public interest.
At the time of inspection of the work of Panchayats under the Jharkhand Panchayati Raj Act 2001, the Chairman can present the difficulties related to the Gram Sabha to the inspecting officer in writing.
Action will be taken if you behave indecently
In the meeting, if any member behaves rudely, uses objectionable words and refuses to withdraw them or apologize, then that member will be guilty of breaking the order and the Speaker can direct any such member to leave the meeting immediately and any member so ordered to leave will do so immediately and will remain absent during the remaining period of the meeting of that day.
