'Liquor Shops Near The Highway Will Not Be Removed', Supreme Court Stays The Decision Of The High Court

The Supreme Court stayed the order of the Rajasthan High Court.

Digital Desk, New Delhi. The Supreme Court stayed the Rajasthan High Court order directing any state to remove or relocate all liquor shops within a limit of 500 meters from national or state highways, citing increase in road accidents.

A bench of Justices Vikram Nath and Sandeep Mehta on Monday issued notice on several petitions filed by liquor sellers and the Rajasthan government, saying the high court's 'concern was genuine' and the government should keep it in mind while formulating its liquor policy in future. The top court ordered, 'Issue notice. The effect and operation of the impugned order is postponed.

Supreme Court stayed the order of Rajasthan High Court

Solicitor General Tushar Mehta, appearing for the state government, said the Supreme Court had earlier directed that there should be no liquor vends within 500 meters of national and state highways, but the problem arose when these roads passed through cities.

'Later the order was clarified that within the municipal limits, there will be no such ban on liquor shops,' he said.

The apex court described the concerns of the High Court as genuine.

Senior advocate Mukul Rohatgi, appearing for the owners of liquor vendors, said the high court had committed a mistake in passing the order without hearing the parties and sought a stay on the directions.

He submitted that the High Court was considering an issue relating to one village, Sujangarh, but passed the order for the entire State without hearing the other parties.

On November 24, 2025, the Jodhpur bench of the High Court, in view of the increasing number of accidents on highways due to consumption of alcohol, directed the State to remove or relocate within two months all liquor shops within the restricted limit of 500 meters from national or state highways, whether they fall under any municipal area, local body or statutory development authority.
