Unknown Person Will Not Get Information About A Person Who Died In A Road Accident - State Information Commission

The bench of State Information Commissioner Mohammad Nadeem has made a big comment regarding seeking information about the person killed in a road accident under RTI from Uttar Pradesh Expressway Authority. The Commission said that there is no justification in providing information to an unknown person regarding a person killed in a road accident.

The bench said that if in future the family members, legal heirs or duly authorized persons of the deceased apply with necessary records, the same will be considered as per law.

The incident is that Guddu Verma, a resident of Lucknow, died in a road accident on the Agra-Lucknow Expressway on the border of Mainpuri district on December 5, 2022.

While submitting an application under the Right to Information Act before the Expressway Tribunal, Neeraj Verma had sought details of the vehicle involved in the accident, details of the FRR registered at Karhal police station, District Mainpuri and certified copies of all the records related to this accident by the department.

On not receiving the information, Neeraj Verma submitted an appeal in the State Information Commission, where Mohammad Nadeem's bench wrote in the order that the applicant is neither a family member of the deceased, nor a legal heir, nor an authorized representative of any kind.

Road accidents and related records are personal and sensitive information related to the deceased, which is protected under the Right to Information Act. Such information cannot be provided without the consent of the family or the order of a competent court. ----
