Big Decision Of Jharkhand High Court: Candidate Will Not Bear The Brunt Of Delay In JPSC Appointment, Will Get Preferential Benefit.

State Bureau, Ranchi. Jharkhand High Court has said in an important decision that the candidate cannot bear the brunt of the delay in issuing appointment letters by the state government or Jharkhand Public Service Commission (JPSC).

The court has ordered that in these cases, the date of appointment of the applicant should be considered from the date of appointment of other candidates of that batch, so that the candidate can get the benefit of preference and other services.

Vandana Bharti had filed a petition in the High Court regarding this. The applicant was a candidate in the third JPSC appointment, whose appointment was delayed by three years in the year 2013 due to wrong calculation of marks, whereas other candidates of her batch were appointed in 2010. Due to the delay his seniority was affected and he was placed at the lowest position among the candidates.

The applicant requested to change the date of his appointment. His lawyers Saurav Shekhar and Anurag Kumar said that the candidate should not bear the brunt of the delay caused by the negligence of the Commission or the government. Accepting the petition, the single bench ordered to give the benefit of preference to the applicant.

The state government and JPSC filed an appeal against this decision. During the hearing, the division bench said that neither the state government nor the Commission are aggrieved parties in this case.

The court asked why it has any objection if the state government corrects its past mistakes? After this the government withdrew the appeal petition. The court has changed the appointment of the applicant from 2013 to 2010.
