Jagran correspondent, New Delhi. The court of Additional Sessions Judge at Patiala House in Delhi reserved its verdict on the anticipatory bail plea of Indian Youth Congress (IYC) general secretary Nigam Bhandari in the case related to the protests during the AI Impact Summit held at Bharat Mandapam. The court will give its order on this on Friday.

Additional Sessions Judge (ASJ) Prashant Sharma reserved the order after hearing the arguments of the accused and Delhi Police. During the hearing, senior advocate Rebecca Jaan, along with advocate Rupesh Singh Bhadauria, appeared on behalf of Nigam Bhandari.

Bhandari was not present at the scene

At the same time, the defense argued that Bhandari was not present at the scene of the incident and had no direct role in the case. It was also argued that the police did not even issue him a notice, whereas as per the directions of the Supreme Court, it is necessary to give notice before arrest.

The defense argued that all the allegations made in the FIR are such that the maximum punishment is less than five years. It was also argued that acts like sloganeering do not constitute crimes under sections 196 and 197 of the Indian Justice Code (BNS).

It is not mandatory to give notice

At the same time, Additional Public Prosecutor Atul Srivastava opposed the anticipatory bail plea and said that it is not mandatory to give notice if the custody of a person is necessary for investigation.

Referring to the situation in Himachal Sadan recently, he said that the police had received information that Bhandari was present there, on the basis of which action was taken.
