Jagran correspondent, New Delhi. A PIL has been filed in the Delhi High Court demanding that the air purifier be included in the category of "medical device" under the Medical Devices Rules 2017. Advocate Kapil Madan has demanded in the petition that the Goods and Services Tax (GST) imposed on these should be reduced from 18 percent to 5 percent.
Currently, there is a tax of 18 percent on air purifiers. A bench headed by the Chief Justice will hear the petition on Wednesday. The petition said that in view of the extremely serious emergency situation arising out of severe air pollution, air purifiers cannot be considered a luxury item.
It also said that imposing the highest level of GST on air purifiers poses a challenge to the economically weaker sections and imposes an arbitrary, unreasonable and constitutionally unacceptable burden. It also said that the air purifier meets the criteria of a “medical device” under the 2020 notification issued by the Central Government.
