PTI, Mumbai. The Bombay High Court has expressed grief over the irony of a society which advocates "Vasudhaiva Kutumbakam" across the world and has fights over inheritance in its own homes. Terming the endless property disputes as a classic example of the disconnect between ancient values ​​and modern reality, the Court hoped that in the larger interest of society, there would be a reduction in bitter and protracted family litigations.

A bench of Justices MS Sonak and Advait Sethna, in its judgment delivered earlier this week, rejected a daughter's plea seeking issuance of letter of administration in respect of her late mother's will, which had given the family property in suburban Bandra to her and her two brothers.

Two other brothers, who were excluded from the will, had cast doubt on their mother's will and claimed it was made by influence and collusion. These two brothers were named as executors of the estate in their father's will, which was made before their mother's will.

The court refused to issue a letter of administration in relation to the mother's will, saying that in its opinion there existed suspicious and suspicious circumstances regarding this will.

According to the petition, the appellant's parents were married in 1933 and had six children (five sons and one daughter). In 1976, the Appellant's father died and in his will he had appointed his wife and two sons as the executors and trustees of the property.

The mother died in 1987 and left a will in which she bequeathed her property to her daughter and two other sons. The two sons who were initially made trustees in their father's will claimed that their mother's will was vague and did not explain why they were excluded from the will.
