High Court Canceled The Order To Stop The Family Pension Of Unmarried Daughter, Gave These Instructions To BSA Farrukhabad

Law correspondent, Prayagraj. Allahabad High Court has canceled the order given by District Basic Education Officer Farrukhabad regarding cancellation of family pension claim of unmarried daughter above 25 years of age. The court has directed to reconsider it in the light of subsequent government orders and pass a fresh order within two months. Justice Prakash Padia has given this order while accepting the petition of Anuradha Ahirwar.

BSA had refused to give family pension to the petitioner citing the old government order of 1989, whereas two government orders have been issued after this. Petitioner's lawyer KK Kesarwani argued that the government had subsequently issued new government orders on December 8, 2008 and December 3, 2012. Under this the petitioner is entitled to pension.

There was no mention of these new orders in the instructions presented by the department. The court said, 'The department has prepared the guidelines without reading the facts given in the petition, which is unfortunate.' The lawyer appearing for the department also accepted that the previous order should be canceled and permission should be given to pass a new order.

Canceling the disputed order of July 21, 2025, the court has directed the District Basic Education Officer, Farrukhabad to provide an opportunity of hearing to the petitioner. Also, within the next two months, pass a new order as per the law and the method established in Kumari Hasin B case.
