Himachal: Woman Dies Due To Negligence In Family Planning Operation, Court Orders Compensation Of Rs 24.60 Lakh

Jagran correspondent, Mandi. A woman died due to medical negligence during a family planning operation in Mandi district of Himachal Pradesh. In this case, Civil Judge Court 2 Sarkaghat has given an important decision. The court has ordered the state government and the concerned doctor to give compensation of Rs 24.60 lakh to the husband and children of the deceased along with six percent annual interest. The amount of Rs 2 lakh given by the government will be adjusted in the compensation. The case is related to Vinod Kumar, resident of village Bagphal tehsil Sarkaghat. Vinod Kumar along with his minor children had filed a civil suit against the government and the doctor demanding compensation of Rs 30 lakh. The suit said that on February 10, 2014, laparoscopic tubectomy was performed on his wife Neelam Kumari at the family planning camp at Primary Health Center Naggar (district Kullu).

The situation had worsened in a short time

His condition deteriorated within a few minutes of the operation, but proper treatment and investigation were not done in time. Later he was referred to Kullu Hospital and then to PGI Chandigarh where he died on 11 February 2014.

Post mortem report and medical board report

The court said in the judgment that laparoscopic sterilization is a valid procedure and complications are possible, but serious negligence has come to light in this case. According to the post-mortem report and the medical board report, the woman died of internal bleeding (hemorrhagic shock) caused by injury to the blood vessels of the mesocolon.

The woman was suffering from anemia, yet did not arrange for blood

The court held that despite the woman showing obvious symptoms of ascites after the operation, the internal bleeding was not diagnosed in time nor was appropriate treatment such as blood transfusion, ultrasound or surgical intervention given. The woman was already suffering from anemia, yet blood was not arranged before the operation. Only general family planning consent was taken from the patient, clear information about the laparoscopic procedure and the risks associated with it was not given, due to which there was lack of informed consent. Keeping all these facts in mind, the court partially accepted the suit considering the post-operative negligence of doctor Anu Sharma as the main cause of death and ordered the government and the doctor to jointly pay compensation.
