Important Decision Of Delhi High Court, Wife Of Person Lying In Coma Made Legal Guardian

Jagran correspondent, New Delhi. The Delhi High Court has appointed the wife of the man, who is in a vegetative (coma-like) state due to a serious illness, as his legal guardian from February 2024. The court gave this decision under the Parens Patriae principle, under which the court intervenes in such cases where the victim is unable to protect her rights on her own.

A bench of Justice Sachin Dutta was hearing the petition, in which the woman said that her husband is in a permanent coma-like condition following intracranial hemorrhage (bleeding within the skull) and is not able to take any decision or perform any activity.

The woman had sought to appoint a legal guardian to manage her husband's movable and immovable properties, financial matters, social security benefits and medical expenses.

The court said that it is clear from the evidence presented that the husband is 100 percent incompetent and it is necessary to appoint a legal guardian for his interest and welfare. The court also noted that both the children of the couple have filed affidavits in favor of their mother without any objection. The Sub-District Magistrate's report and the medical report also corroborated the claims of the petitioner.

The High Court has given the wife the right to take decisions in matters related to her husband's treatment, care, daily expenses, financial management and his property, so that her interests can be ensured.
