Digital Desk, New Delhi. The Supreme Court has said that providing admission to children from Economically and Socially Weaker Section (EWS) in education should be a "national mission". The Court on Tuesday directed the Central and State Governments to frame clear rules and regulations to effectively implement the provision of 25 per cent reservation in private non-minority, unaided schools.

A bench of Justices PM Narasimha and Atul S Chandurkar said it was the responsibility of the concerned government and the local authority to grant admission to children belonging to the EWS category. At the same time, the courts should also go “one extra step” to provide prompt and effective relief to the parents in such cases.

The bench was hearing a plea in which a person complained that despite seats being available in 2016, his children did not get admission in free education under RTE in a neighborhood school.

The Bombay High Court had rejected the petition on the grounds of not following the online procedure. The Supreme Court held that seats reserved for children from weaker sections become inaccessible in practice due to factors such as online application system, digital illiteracy, language barrier, lack of helpdesk, lack of information about seats and vagueness of grievance redressal mechanism.

The court said that without clear and binding rules, the purpose of Article 21A (Right to Education) of the Constitution and Section 12(1)(c) of the RTE Act will remain ineffective. Therefore, rules under Section 38 should be made in consultation with NCPCR, State Child Rights Commissions and Advisory Councils.
