More Than 52 Thousand People Still Missing In Delhi Since 2016, High Court Seeks Answers From Central And State Government

The Delhi High Court has sought response from the Center and the Delhi Government on a petition filed with other demands including filing of FIR without delay in cases of children and people of different age groups going missing in the national capital year after year.

Next hearing on 18th February

A bench of Chief Justice Devendra Kumar Upadhyay and Justice Tejas Karia adjourned the hearing of the case till February 18, asking whether any such case was pending before the Supreme Court. The court also asked the Central and Delhi governments to present their stand on the matter. The next hearing on the case will be held on February 18.

In the petition filed by NGO Freedom Re-Claimed Chairperson and advocate Ayushi Mittal, it was said that this petition is related to about 52,326 people missing since 2016, who have not been traced till date. Advocates Abhishek Tiwar and Devesh, appearing on behalf of the petitioner, said that from the government to the Delhi Police, they have failed to fulfill their legal responsibilities and this failure is not a matter of administrative monitoring, but of the failure of the law enforcement system.

Figures include 6,931 missing children

While presenting the figures, it was said on behalf of the petitioner that 800 people went missing from Delhi in the first 15 days of the year 2026. It also argued that according to the official records of Delhi Police, a total of 2,32,737 people were reported missing in Delhi between 2016 and January 15, 2026 and out of these, 52,326 people have not been traced till date. The petition said that the disturbing thing is that this figure includes 6,931 missing children (under the age of 18 years) and they have not been found yet.

Pointing towards a thriving ecosystem

Due to this, the fundamental right to life, dignity and personal liberty guaranteed under Article 21 of the Constitution is being continuously and collectively violated. Advocate Abhishek Tiwari said that the current situation is so serious and worrying that the court will have to look beyond a standard investigation. The disappearance of more than 800 people points to organized crime as well as a thriving ecosystem for human trafficking and other serious criminal activity.

Technical and data audit should be done on Genet portal.

The petitioner demanded that instead of waiting for the golden hour in the missing persons case, a direction should be given to lodge an FIR immediately. Also, technical and data audit should be conducted on the GENET portal from time to time, so that it can be ensured that the information of any missing person is not uploaded without the prescribed procedure.
