Jagran correspondent, New Delhi. In the dispute over property worth Rs 30,000 crore of late industrialist Sunay Kapur, his wife Priya Kapoor and his minor son presented arguments in the Delhi High Court.
Senior advocate Akhil Sibal, appearing for Priya Kapoor and her son, told the bench of Justice Jyoti Singh that the court has no power to stop Sanjay Kapoor from seeking ownership of his immovable properties in the UK and the US. He argued that Priya Kapoor has no intention of selling the shares of Ars Investment Private Limited (AIPL) transferred to her after Sanjay Kapoor's death.
But so far as immovable properties situated in the US and the UK are concerned, the High Court has no jurisdiction to pass status quo orders in respect of them. Sibal said this court has no jurisdiction to declare and partition ownership in respect of foreign immovable property.
The court is hearing the case filed by the sons of actress Karisma Kapoor. The authenticity of Sanjay Kapoor's will has been challenged in the petition. Karisma Kapoor's children have sought a share in the property of their father Sanjay Kapoor. Meanwhile, senior lawyer Mahesh Jethmalani, appearing on behalf of Karisma Kapoor's children, said that the court can pass an order to stop Priya Kapoor from misusing the fake will to get ownership of properties located abroad. Sibal then said that there is no such prayer in the interim injunction application filed by Karisma Kapoor's children. However, the court said that the application seeking interim injunction would not be heard any further.
The court also listed the matter for December 22, directing both the parties to file their written statements in the matter.

Priya Kapoor's son came out in protest against the petition of Karisma Kapoor's children, said - the matter is based on speculation and conjecture.
