Rakesh Kumar Singh, New Delhi. The Delhi government has now decided to speed up the system of banning habitual offenders (BCs) living in the capital to prevent them from committing repeated crimes. This provision in the law is quite old. Earlier, there was a provision to ban BC under Section 110G of IPC, now there is a provision to ban BC under Section 128 and 129 of BNS. ,

In the last several years, the issue of banning BC by the district administration in Delhi was lying on the back burner because there was a lot of lack of mutual coordination between the previous Delhi government and Delhi Police.

Due to lack of better coordination, this issue was not being given any attention from both the police and the district administration for a long time. But now with the coming of BJP government in Delhi, there has been better coordination of Delhi Police with the government. Therefore, efforts will now be made from both sides to speed up banning of BC.

The rule says that a person against whom there are three or more cases of criminal cases other than road accident, petty crime like assault, theft, snatching, robbery etc., can be declared a criminal by the police station incharge of the concerned area.

Its report is prepared by the police station head and sent to the DCP of the concerned district, after which approval is given by the DCP. The DCP has full authority to give approval to make someone a BC or not after examining the report of the police station incharge.

After that the process of pambading the BC starts. There are many ways to restrict. Based on the report of the police station head, the SDM has the right to restrain the BC at different times for one year, two years or three years so that the BC does not quarrel or fight with anyone again and again and does not disturb the peace. There are different conditions in this that violating the restrictions can lead to fine and district ban.

Due to this, there was a kind of panic somewhere in BC, they avoided violating the orders of the district administration. Till now it used to be that if the police station head prepared a report regarding banning BC and sent it to the SDM, then the SDM did not implement it. The police officer says that only ten percent of the cases were implemented.

The police officer says that there are many police stations in some districts like New Delhi where there is not even a single declared criminal. But there are many police stations where more than 100 BCs live. There are PCR calls about fights and assault every day in that police station area.

The Revenue Department of Delhi Government has decided to ban such people from January under sections 128 and 129 of the Indian Civil Security Code (BNSS) 2023. For this, Delhi Government has imposed the duty of SDM through the Executive Magistrate. These Executive Magistrates (SDMs) will organize camps in the month of January and arrest the criminals in the control rooms of different tehsils from 2 to 4 pm.

Camps will be set up to crack down on criminals

The schedule of these camps will also be released by the government. Along with the SDM of the places where these camps will be set up, other SDMs will also be made link duty magistrates. In this regard, the order issued by the Revenue Department of Delhi Government states that the Duty Magistrate will do his duty in the control room (Duty Magistrate Room) of the office of the Secretary (Revenue)-cum-Divisional Commissioner, located at Nath Marg, Delhi, between 2 pm to 4 pm on the dates mentioned in the schedule.

No officer on duty as a Duty Magistrate shall be entitled to leave of any kind unless sanctioned and informed to the Link Magistrate.

If both the Duty Magistrate and the Link Magistrate are not available on the respective dates due to any unforeseen or unavoidable reason, the concerned District Magistrate will make alternative arrangements for that day in respect of such Duty Magistrate. Non-compliance will be taken seriously. Two SDMs will be put on duty for the camp on 26th January, Republic Day also. On this issue, the police officer says that by taking such steps by the government, criminal activities will be stopped and the people who are banned will be afraid of committing crimes again and again. Because they would know that they have been put on bond. If he is found involved in any criminal activities, strict legal action will be taken against him.
