ADA Had Collected Rs 84 Thousand By Raising Objection On The Map, After 25 Years The Building Owner Had To Return Rs 6.89 Lakh

Jasan, Agra. The amount collected in the name of getting the map passed by raising objections became a burden on ADA. Instead of Rs 84 thousand 839 recovered, after 25 years, ADA had to pay Rs 6.89 lakh along with interest to the victim. The Consumer Commission had given an order in favor of the victim in the year 2002.

Manju Kansal, resident of Madiya Katra Lata Kunj, had purchased plot number 43 of Bharatpur House on January 16, 1998 from Sanjeev Bajaj of Chetna Housing Society for the construction of a building. ADA had approved the said colony on 17 September 1984 after receiving all the development fees along with the charges from the colonizer.

The complainant applied to ADA on August 5, 1998 along with the fee for a copy of the sale deed, to get the building plan approved for construction on his plot. It is alleged that ADA neither approved nor rejected the map for 90 days. The complainant sent a legal notice to ADA asking them to pass or reject his map within 30 days. If she does not do so, she will consider the map passed.

No action was taken by ADA after the notice. On this, the complainant started digging the foundation on the plot in the year 1999. On this, the work was stopped by giving notice from ADA. Even after depositing the fees, the colonizer was asked to give approval for the construction only after depositing Rs 84839. The complainant was forced to deposit the said amount.

In 1999, a case was filed in Consumer Commission I regarding illegal recovery. On November 26, 2002, the Commission directed the ADA to pay Rs 50,000 to the victim as compensation for mental distress along with the recovered amount. ADA appealed against the order to the State Consumer Commission, Lucknow.

From there also, when the order was in favor of the victim, ADA was forced to pay Rs 6.89 lakh to the victim along with interest. On Friday, Consumer Commission First Chairman Sarvesh Kumar handed over a check of the said amount to the victim Manju Kansal and her husband Yogesh Kumar Kansal.
