Allahabad HC Strict On Implementation Of Maternity Benefit Act In Educational Institutions, Sought Information About The Law

Allahabad High Court has asked the Central and State Governments as to what steps have been taken so far to make the Maternity Benefit Act 1961 effective in the educational institutions of the state. The court has asked for a detailed affidavit while directing to make the state's Additional Chief Secretary Secondary Education a party in this case.

This order has been given by the division bench of Justice Ajit Kumar and Justice Swaroopama Chaturvedi on the petition of Sunbeam Women's College, Varuna Varanasi. In the petition, the institute has challenged the commission's order for reinstatement of a female employee and giving her maternity benefits.

The institute argues that unless the state government issues a special notification in the official gazette with the permission of the Centre, the Act is not legally applicable to private educational institutions. Citing various decisions of the Supreme Court, the petitioner said that educational institutions do not fall in the category of shops or commercial establishments.

The High Court said that it is a beneficial law and it was the duty of the State Government to notify it for the benefit of the people working in various institutions. The next hearing in the case will be on March 23.
