Application To Withdraw The Case In Akhlaq Mob Lynching Case, Now The Court Will Hear The Case On December 18.

Jagran correspondent, Greater Noida. A hearing was held in the court of Additional District and Sessions Judge (FTC-1) on Friday regarding the withdrawal of the ongoing case against the accused in the Akhlaq mob lynching incident in Bisahada village of Jarcha Kotwali area.

The court has fixed December 18 for hearing in the case without hearing the arguments of the lawyers. Advocate Bhag Singh Bhati from the prosecution side and advocate Yusuf Saifi from the victim's side were present in the court.

After coming out of the court, the victim's advocate Yusuf Saifi said that the next hearing in the case will be held on December 18. CPIM leader Vrinda Karat was also present in the court on Friday.

He said that the justice system is being challenged by the government. Testimony is going on in the mob lynching case. Withdrawal of such a case shows the mentality of the government. We will stand with the suffering party.

In the popular case pending in the court, a petition for withdrawal of the case was filed by the prosecution. Following the orders of the Government and Joint Director of Prosecution, an application has been given in the court by the Assistant District Government Advocate (Criminal).

In this, permission has been sought to pass the order to withdraw the case in view of the restoration of social harmony. According to the government order issued on 26 August 2025 by Justice Section-5 (Criminal) Lucknow of Uttar Pradesh Government, it was decided to withdraw this case.

The Joint Director of Prosecution had issued a letter on September 12, 2025, instructing the District Government Advocate (Criminal) to take action in this regard. It was said in the letter that the Governor has given permission to withdraw the prosecution.

This action has been taken under Section 321 of the Code of Criminal Procedure. An application for withdrawal of the case was filed by the prosecution on October 15. Testimony is going on in the case. The last hearing was held on 12 November-2025.

The court had given Friday date for hearing in the case, but the hearing time has been extended again. Regarding the matter, the relatives of the deceased say that they will make further strategy only after the court's decision in the matter.

On the night of 28 September 2015, village resident Akhlaq was beaten to death by a mob in Bisahada village of Jarcha police station area after a rumor of beef consumption. His son Danish was seriously injured. Akhlaq's wife Ikraman had filed a case against 10 people.

During the police investigation, statements of eyewitnesses wife Ikraman, mother Asgari, daughter Shahista and son Danish were recorded. The names of 10 accused had appeared in the initial statements. In subsequent statements, witnesses added 16 more names. 16 accused were mentioned in the statement of Akhlaq's daughter Shahista dated 26 November 2015.

On December 5, 2015, Danish had given the names of 19 people. The investigator had filed the charge sheet against 18 accused in the court on 22 December 2015. Currently all the accused are on bail.
