State Bureau, Ranchi. Former Barkagaon MLA Amba Prasad has accused the displaced villagers of demanding their constitutional rights in protest against big industrial projects like NTPC, CCL and Adani in Hazaribagh district.
He has raised the question whether the DC and SP of Hazaribagh are above the Supreme Court? The administration is adopting a repressive attitude against the villagers who are protesting peacefully.
Amba Prasad said that the police have added serious sections in the case number 136/25 registered in the Pagar case of Keredari police station area due to political and corporate pressure. In the incident in which no one was physically harmed, serious sections like attempt to murder were imposed.
Calling it a fake case, he has described it as an example of police atrocities. Said that the police has ignored the instructions given in the Supreme Court's Satendra Kumar Antil vs. CBI decision.
In the said decision, there is a clear instruction not to make arrests without warrant or 41A notice in cases involving punishment of less than seven years. Despite this, the arrest was made without notice and warrant.
On Wednesday, agitator Birju Mahato was forcibly picked up from the protest site and sent to judicial custody. Other displaced people were also beaten up in the police station.
He has raised the question whether the administration and the concerned officials are above the orders of the Supreme Court. He has demanded the Jharkhand High Court and the Supreme Court to take suo motu cognizance of the unconstitutional repression in Hazaribagh.
Amba said that the law is being misused to suppress the peaceful movement to protect the rights related to water, forest and land.
