Jagran correspondent, New Delhi. Tis Hazari's sessions court canceled the order framing charges of cruelty against the woman's brother-in-law in the dowry death case. The court said that a mere allegation regarding lack of a pair of clothes, one of the traditional gifts given at the time of marriage, cannot amount to dowry demand or harassment. The court said that the post-mortem report did not show any external injuries and the cause of death was stated to be liver failure, which was a natural cause of death.
Sessions Judge Saurabh Kulshrestha said that no evidence could be produced in relation to the charges leveled against the accused and the magistrate had clearly committed illegality by directing framing of charges against the accused. The court gave the said order overturning the magistrate court's decision of March 2022. The Magistrate Court had framed the charge of dowry cruelty against the appellant.
The court said that on March 22, 2023, the magistrate had acquitted all the accused in the case except Deepak. The court had ordered to frame charges against Deepak. The court said that according to the Magistrate Court, Deepak was accused of objecting to the number of clothes given at the time of marriage and insulting the parents of the deceased woman.
The woman married Deepak's brother Kuldeep in 2016. The woman had alleged that several dowry items were demanded at the time of marriage and on October 7, 2018, when Mansi became pregnant, she died due to negligence in her treatment by her husband and in-laws. Nangloi police station had filed an FIR based on the complaint of the woman's sister after her death.
