Complaints Which Are Not FIR Should Also Be Included On NCRB Portal: Delhi High Court

Delhi High Court directed to take major steps to strengthen the criminal justice data system of the country.

Taking a major step to strengthen the criminal justice data system of the country, the Delhi High Court has directed that possibilities should be explored to add data of complaints not converted into FIRs and complaint cases pending or disposed of in courts on the NCRB portal.

A bench of Justices Pratiba M Singh and Madhu Jain asked the Director of NCRB and the DDG of NIC to file a status report as to what steps have been taken so far to link such data with the portal.

The High Court said that only the data of FIR and punished cases on the NCRB portal is not enough. This should also include records of other pending cases against jail inmates, complaints not converted into FIRs and personal complaint cases pending and disposed of in courts.

The court made this comment during the hearing on the appeal of Parveen Taneja, who has been sentenced to life imprisonment for the murder of his wife. The court rejected the appellant's demand for suspension of sentence and bail. The court said that two witnesses have confirmed the presence of the accused at the spot and photographs from the scene show the brutality of the murder.

The High Court had earlier also cited the decisions of the Supreme Court and said that complete information about the criminal history of those seeking bail or sentence suspension is necessary. The court had also directed that applicants should disclose their criminal records through affidavits and court data should be linked to the NCRB portal, so that cases do not get delayed due to repeated non-receipt of information.

Along with this, the court has sought a report from Delhi Legal Services Authority (South-East) on the status of compensation to the victim's family. The next hearing in the case will be on April 16.
