Dozens Of Murder-dowry Cases In Bhagalpur Stuck For 20-25 Years, Police Investigators And Doctors Not Coming To Court To Testify

Kaushal Kishore Mishra, Bhagalpur. Patna High Court is conducting day-to-day hearing of old cases on the strategy of reducing the record of cases by ending long pendency. Here, in an effort to end the pendency of the Patna High Court, some police officers are hell-bent on creating havoc.

Even in the Civil Court, Bhagalpur, there are more than three dozen such murder cases which are pending till the decision stage without the testimony of researchers and doctors. Many of these cases are stuck for 20 years without the testimony of the investigating police officer.

There are many such cases in which, in case the judge does not come continuously for a long time, first bailable and then non-bailable i.e. arrest warrant is issued. During the hearing in these pending cases, the judge has even warned of stopping the salaries of the SP-SSP, but till now the police has not been successful in making the witnesses present, but till now they have not been arrested and presented in the court.

As a result, the decision in the case has been stuck for a long time. According to Additional Public Prosecutor Rajesh Kumar Singh, there are many such cases in which investigators have not been coming for a long time. In the Sabour-Lodipur murder case that took place 25 years ago, the then police station chief Muhammad Shamim and doctor Dr. Arrest warrant is also issued against Arun Kumar Singh but his testimony has not been taken.

Such is the situation in many murder cases. As a result, cases related to serious matters have reached a weak state. The benefit of which is likely to accrue to the accused party. The situation is similar in many cases of murderous assault, Explosive Substances Act, dowry death, kidnapping, robbery etc.

25 years ago, Mojibur Rahman, a resident of Lodipur Kurudih village of the then Sabour police station area, was fatally attacked on June 23, 2000 for not paying Rs 25,000 as extortion money. He was then admitted to Jawaharlal Nehru Hospital by his brother and other family members where he died during treatment on July 1, 2000.

In this case, the then police station incharge Muhammad Shamim who is currently in Patna. In the year 2011, he was posted under special branch surveillance. Despite his presence in Patna, his testimony has not been done yet. Arrest warrant is issued against them. The doctor who conducted the post-mortem in this case, Dr. Arun Kumar Singh also could not testify. Non-bailable warrant has been issued against them also. There is a direction for day-to-day hearing in the case on the instructions of the High Court.

On September 25, 2022, cloth hawker Muhammad Sunny was shot dead near Karori market of Habibpur police station area. There was so much anger among the local people regarding the murder that the accused of murder, Muhammad Dilshad alias DJ, was caught and beaten brutally. Somehow life was saved when the police team arrived.

The testimony of Inspector Kripa Sagar, the investigator in that case, has not been heard yet. It is only because of his testimony that the case is stuck in reaching its final stage. His posting is said to be in Chhapra district. Chapra SP has been instructed through Bhagalpur SSP to present them immediately.

The testimony of the investigator and the informant could not be taken in the case of dowry death in Khalifabagh street in Sessionalism case number 765-17 of Kotwali police station area. In this case too, the court has issued an arrest warrant against the researcher and the informant for not appearing for testimony on several consecutive dates.

In the case number 162-17 of honor killing in Shahkund-Sajor police station area, the case is stuck due to lack of testimony of the investigator.
