State Bureau, Chandigarh. The Punjab and Haryana High Court has refused to grant bail to a woman accused of allegedly inciting a bouncer to commit suicide by befriending her through Instagram. The court said that the allegations are of serious nature and the name of the accused has also surfaced in another similar case, hence it would not be appropriate to release him.
Justice Manisha Batra was hearing the second bail plea filed by the woman, Priya. In the petition, the accused claimed to be innocent and demanded release. After hearing the petition filed on February 18, the court made it clear that considering the nature of the allegations, the possible punishment and the overall circumstances, the petitioner is not entitled to bail.
Threat of being implicated in rape case
According to the case, deceased Dimple was working as a bouncer in a hospital. Complainant Surendra Kumar, who is the father of the deceased, alleged that a woman named Priya, who worked at a shop in Ambala, came in contact with his son through Instagram and later started demanding money and expensive gifts from him. She used to threaten to implicate him in a rape case if her demands were not met.
During the investigation, the police collected copies of mobile chats, which revealed continuous conversations between the accused, the deceased, his mother and sister. It was also found that the accused was using three different Instagram IDs. During interrogation, the accused described himself as a divorcee and admitted that he had relations with the deceased and asked for money and gifts from her.
FIR registered in case of extortion
According to the police, she also admitted that when the deceased expressed his inability to pay the money and talked about committing suicide, she angrily asked him to do so. Later she learned that he actually committed suicide by consuming poison. Investigation also revealed that earlier also an FIR was registered against him in a similar case of extorting money from another person.
The court, while perusing the chat records and other evidence, said that prima facie the allegations are serious and indicate that the crime may have been committed by the accused. The bench said that if bail is granted on such charges, the possibility of influencing witnesses or absconding cannot be ruled out.
The petitioner's lawyer argued that the woman has been in custody for a long time, she has minor children and the trial will take time. However, the state protested that the conduct and antecedents of the accused were not clean and there was a possibility of him committing similar crimes again.
After hearing all the parties, the High Court said that considering the evidence available and the seriousness of the allegations, this is not a suitable case for bail. The court rejected the bail plea.
