State Bureau, Ahmedabad. Gujarat Waqf Board will no longer get waiver of court fees in the High Court. Like Hindu trusts and institutions, mosques, dargahs and waqfs will have to pay court fees in the courts.
Deputy Chief Minister Harsh Sanghvi described the High Court's decision as historic and said that everyone is equal before the law. The Waqf Tribunal of the state government, while hearing the Waqf properties, had ordered the Waqf Board to pay the court fees. This decision was challenged by the Waqf Board in the High Court.
Not till now Waqf did not have to pay fees
The government lawyer said that the objective of the state government is to make all citizens and institutions equal. Till now, Hindu temples and institutions had to pay court fees but due to law, Waqf did not have to pay any court fees.
Waqf will also have to pay fees like other religious institutions.
The state government said that no special exemption should be given to any institution or trust. While hearing the cases of about 150 properties of Waqf Board, the High Court said that court fees cannot be waived. Like other religious institutions and trusts, now Waqf will also have to pay court fees.
