State Bureau, Ranchi. The court of Justice Anand Sen of Jharkhand High Court has rejected the petition of two retired Assistant Forest Conservator Officers (ACF) seeking extension of service of one year. The court said that giving extension in employment to retired employees is not a solution nor can it be made a rule.
The High Court refused to accept such a demand, saying that the state government is well aware of the retirement date of its employees and should plan for it in advance. The court has said in its order that even before retirement, the state government should start the process of filling the post which is going to become vacant due to the retirement of the employee.
The court said that in this case the state did not take any action to fill the post, but instead gave extension of service to the retired employees and allowed them to continue working. Giving extension to retired employees is not good for the development of the organization. In this regard, Avinash Kumar Parmar and Abhay Kumar Sinha had filed a petition in the High Court.
In which it was said that his services have already been extended from July 1, 2024 to June 30, 2025. He had sought instructions to the Principal Secretary of the State Forest Department to grant him immediate permission to extend his services from July 1, 2025 to June 30, 2026, as recommended by the officials.
After the hearing, the court has clarified that the court cannot give instructions to give extension of service to any retired employee. No retired employee has any right to get extension of service after retirement.
