Digital Desk, Chandigarh. The Supreme Court on Tuesday postponed the hearing till March 11 on the application of Jagtar Singh Hawara, convicted of Beant Singh's murder. Hawara had demanded transfer from Tihar Jail in Delhi to any jail in Punjab. This Babbar Khalsa terrorist is serving life imprisonment in a case related to the murder of the former Chief Minister of Punjab in 1995.
A bench of Justices MM Sundaresh and N Kotishwar Singh adjourned the matter after Solicitor General Tushar Mehta sought adjournment. On September 27 last year, the Supreme Court had issued notices to the Centre, Chandigarh administration and Delhi and Punjab governments on Hawara's application.
The explosion took place in 1995
Hawara is serving the rest of his life in jail in the case related to the blast at the entrance of Civil Secretariat in Chandigarh on August 31, 1995. Beant Singh and 16 others were killed in this attack.
The application filed in the Supreme Court said that Hawara's conduct in prison has been spotless, except for an alleged case of escape from prison on January 22, 2004. It said that he should be transferred from Delhi's Tihar Jail to some other jail in Punjab as there is no case pending against him in the national capital. It said, “The petitioner (Hawara) is currently serving life imprisonment for the rest of his life in a case registered in the State of Punjab… He is a resident of Fatehgarh Sahib District, State of Punjab, and should be lodged in a jail in Punjab.
36 false cases were filed
According to the application, 36 false cases were imposed against the applicant after the murder and he has been acquitted in all but one case. It said that a person involved in the same case and jailbreak has been shifted from Tihar to Chandigarh jail.
The petition said that the mere fact that the petitioner was considered a high-risk prisoner years ago is not a sufficient reason to keep the prisoner in Delhi today and not send him to Punjab.
It was also said that his daughter is in Punjab. Hawara's wife has died and his mother is in a coma in America. The petition said that the question that arises in this case is whether a person who is accused of committing murder during a time of serious social unrest, but who has been living in jail without any blame for the last 19 years, can seek an order from this court for transfer to a jail in Punjab.
Sentence was given in March 2007
Let us tell you that in March 2007, Hawara was sentenced to death by a trial court in this case. The Punjab and Haryana High Court commuted his sentence to life imprisonment in October 2010 and directed that he would not be released from prison for the rest of his life. Hawara's petition states that his and the prosecution's appeals against the High Court's decision are pending in the Supreme Court.
