Amicus curiae appointed in the case of reserving supervisor posts for women
State Bureau, Ranchi. The matter of reserving 100 percent seats for women in the appointment of women supervisors was heard on Wednesday in the court of High Court Chief Justice MS Sonak and Justice Rajesh Shankar.
After the hearing, the High Court appointed advocate Anup Kumar Mehta as an amicus curiae in the case. He will cooperate with the court during the hearing. The court has directed all the parties to submit written arguments in the case. The next hearing in the case will be on March 18.
This case was earlier heard in a single bench of the High Court. The single bench had referred the matter to the division bench raising this important question whether any post can be reserved 100 percent for women.
After this, the division bench headed by the Chief Justice is hearing the case. In this regard, a petition has been filed in the single bench of the High Court on behalf of Anju Kumari and others.
Before the single bench, Advocate General Rajiv Ranjan had said that the post of Lady Supervisor has been created only for the women cadre, because the scope of work of this post is related to pregnant women, mothers of newborn babies and other women groups.
He had said that the work of women supervisors is mainly related to women, hence this post has been earmarked only for women. Such a system is applicable in other states of the country also.
On behalf of the applicant, Advocate Ajit Kumar and Advocate Chanchal Jain said that giving 100% reservation to any category in the appointment process is not in accordance with the Constitution. He objected that in this advertisement applications were sought only from women, which is not legal.
The matter is related to the appointment of 421 posts of women supervisors in the Child Welfare Department. JSSC had released advertisement for these posts. The applicants had also appeared in the examination, but the Commission did not select them saying that their educational qualifications were not in accordance with the conditions of the advertisement.
The candidates must have a degree in subsidiary subjects instead of the degree in the main subject as prescribed in the advertisement, whereas such a requirement is not clearly mentioned in the appointment rules. During the hearing, the issue was also raised whether 100% reservation can be given to any category in the appointment process.
