Jagran correspondent, Bhagalpur. 23 years ago, the victim's marriage with the accused of rape in the Panchayat, just a few days later, dowry harassment and triple talaq dispute in the same relationship and now punishment from the court. In this unusual case involving complex layers of crime, social compromise and lengthy judicial process, a decisive hearing took place in the court of First District Sessions Judge Milan Kumar on Wednesday.

In this Jagdishpur case, the court sentenced Muhammad Wasim alias Guddu, who was found guilty in both rape and dowry harassment cases, to seven years of rigorous imprisonment for rape. The court also imposed a fine of Rs 5,000, failure to pay which will result in additional simple imprisonment of three months.

The court also sentenced her to three years rigorous imprisonment and a fine of Rs 2,000 for dowry harassment. All sentences will run concurrently. Additional Public Prosecutor Shri Kishore Yadav argued on behalf of the government.

The incident occurred on 27th November 2003 at around 7.30 pm. The girl from Jagdishpur police station area had gone to the fields for defecation as usual. At the same time, Muhammad Wasim alias Guddu, who had already ambushed her, raped her by threatening her with a knife. When she tried to protest and make noise, Wasim held a knife to the girl's throat and threatened to shoot her. The girl then remained calm to save her life.

When she came home from there, she informed her parents about the incident. When the girl's relatives reached Wasim's house with the complaint, efforts to avoid legal action began. Wasim's father tried to hush up the matter by promising to arrange the marriage within a week. Later, when the delay started, a Panchayat was held in the village and under social pressure, the marriage of rape accused Wasim and the victim was done.

This decision was considered a solution to stop the dispute at that time, but later on this relationship became the cause of a new dispute. Just a week after the marriage, the girl was sent to her maternal home with the promise that she would be sent away later, but her in-laws did not call her back. It is alleged that after this, Rs 20,000 in cash and other items were demanded as dowry.

When the demands were not met, the rift in the relationship increased and ultimately Wasim got married for the second time by giving triple talaq on mobile phone. Hurt by the incident, the victim approached the court.

A case was registered in Jagdishpur police station on the orders of the Chief Judicial Magistrate and the period of the incident was shown to be between 27 November to 22 December 2003. After going through the process of police investigation, evidence collection and lengthy judicial hearing, the case finally reached the Sessions Court, where the verdict was given now after 23 years.
