Digital Desk, Guna. For a mother, seeing the dead body of her only son in front of her eyes is the greatest pain in the world. But for Guna's Alka Jain the sorrow did not end here. The police arrested her and sent her to jail on charges of murder of the son whose death she had not been able to recover from. Now the Gwalior bench of Madhya Pradesh High Court has intervened in this case and quashed all the charges against Alka Jain and has made strong comments on the functioning of the lower court.
That fateful day of 14th February
Alka Jain was married to Anupam Jain, a bank employee, on 1 June 2006 in Bhopal. On 1 February 2011, a son (Abhyudaya) was born to them. Alka was living in Guna with her 15-year-old son due to her husband's transfer. On the morning of 14 February 2025, Alka found her only son hanging in the bathroom of her house. The upset mother immediately ran to the district hospital with him, but the doctors declared him dead.
Didn't even get time to mourn, became a murderer
In the post-mortem report (15 February 2025), the cause of death was declared as 'strangulation'. On this basis, Guna Police registered a case against unknown on 22 February 2025 under Section 103 (Murder) of the Indian Justice Code. In the investigation, considering the mother (Alka) as the direct accused, she was arrested on 8 March 2025. However, later on June 16, 2025, he got regular bail from the High Court.
Father's plea and police's acquittal report
Alka's husband complained against this injustice to the police headquarters. After this a special investigation team was formed by the Superintendent of Police, Guna. Investigation revealed that Abhyudaya was depressed regarding his studies. His grades were continuously falling; It had fallen from 89.5 percent in fifth grade to 64.7 percent in seventh. The Special Investigation Team clearly said that there was no evidence against the mother. After the approval of the Inspector General of Police, Deputy Inspector General and Superintendent of Police, the 'completion report' was presented in the court.

Stubbornness of the lower court and justice received from the High Court
A new twist in the story came when the Chief Judicial Magistrate of Guna rejected this police report. On May 9, 2025, without any concrete evidence, on the basis of mere suspicions (e.g. mother was in the house, she was the one who hanged herself, etc.), the Magistrate took cognizance under Sections 103 and 238 of the Indian Justice Code and ordered to prosecute the mother. Ultimately, the case reached the High Court. On February 9, 2026, a bench of Justice Milind Ramesh Phadke, while hearing the case, clarified:
Canceling the order of the Chief Judicial Magistrate dated May 9, 2025, the High Court has forever quashed all the criminal proceedings (Crime No. 115/2025) of Police Station Kotwali Guna going on against Alka Jain. Alka is now free in the eyes of the law, but perhaps no court can compensate for the pain she has suffered from losing her only son and being called a murderer in the society.
