NGT Imposes Fine Of Rs 50 Thousand On DPCC On Transfer Of Compensation Fee

NGT imposed a fine of Rs 50,000 on DPCC for delay in transfer of compensation fee.

The National Green Tribunal (NGT) has imposed a fine of Rs 50,000 on the Delhi Pollution Control Committee (DPCC) for inordinate delay in transferring compensation charges to the Forest and Wildlife Department. A bench headed by NGT Chairman Justice Prakash Srivastava said that DPCC's non-compliance of NGT orders by making baseless excuses and reasons for delay in transferring the compensation amount are not acceptable. NGT took on record that the delay in transfer of compensation fee was due to shifting of its office. NGT said that the reason given for delay of more than a year in transfer of fees is completely wrong. The NGT said that disobeying the tribunal's order is an offense and the DPCC Chairman and Member Secretary can also be prosecuted for such violations.

The NGT said that, however, the tribunal does not consider it appropriate to direct prosecution. However, it would be appropriate to impose a fine on DPCC for this. In November 2023, the NGT had directed the DPCC to release Rs 8 lakh collected as environmental compensation from four illegal stone-breaking units in Nilothi village to the Forest and Wildlife Department. Also, the department was directed that the said amount will be used for tree planting works in the village. Along with this, NGT imposed a fine of Rs 50,000 on DPCC and said that this amount will be used in facilities for the public visiting NGT. Also directed the Forest and Wildlife Department to utilize Rs 8 lakh for tree plantation and submit the report within six months.
