The Supreme Court is hearing the Election Commission's response to West Bengal Chief Minister Mamata Banerjee's petition challenging the Special Intensive Revision (SIR) in the state. The case was heard by a bench of Chief Justice of India Surya Kant, Justice Joymalya Bagchi and Justice Vipul M Pancholi.
Supreme Court asked many questions to Bengal government
Making serious allegations against the Election Commission in this matter, the Chief Minister of West Bengal has raised the issue of a logically flawed list of more than 1.36 crore voters in the Supreme Court.
He claimed that the names of these voters are in danger of being removed on the basis of systematic mistakes like 'wrong spelling in surname' or change of addresses of daughters after marriage.
Mamata also raised the issue of deployment of 8,300 micro-observers appointed by the Election Commission in the state, whom she claimed to be officials of the Central government. Mamta has also talked about removing the names of voters in an unconstitutional manner without any authority.
Mamata became the first serving Chief Minister to argue in the Supreme Court
Let us tell you that a petition has been filed in the Supreme Court alleging that Bengal Chief Minister Mamata Banerjee's personal appearance in the apex court in the Special Intensive Revision (SIR) case of voter lists was constitutionally inappropriate and legally wrong. Mamata Banerjee became the first serving Chief Minister to argue in the Supreme Court on February 4.
A bench of Chief Justice Surya Kant, Justice Joymalya Bagchi and Justice NV Anjania on Monday heard some petitions related to SIR in Bengal, including Banerjee's petition opposing the Commission's exercise.
Demand to intervene in the petition
The petition filed by former vice-president of Akhil Bharat Hindu Mahasabha, Satish Kumar Agarwal, has sought intervention in Banerjee's petition. It said that the subject matter of Banerjee's petition is not a personal or private dispute, but it is a matter of state governance and the right of the Election Commission to conduct SIR as per the Constitution and election laws.
In such circumstances, Mamata Banerjee cannot claim to appear in her personal capacity and Bengal should be represented in this court through lawyers and the appointed lawyers are already representing Bengal.
