Abhishek Tripathi, Jagran Mumbai: Now Pakistan seems to be stuck on the decision of not playing the T20 World Cup match against India on March 15 in Sri Lanka. Pakistan Cricket Board (PCB) had written a two-line email to the International Cricket Council (ICC) that it cannot play the match against India under the force majeure (unexpected or uncontrollable situation) provision.

After this, ICC asked Pakistan to clarify how this matter comes under the force majeure provision of the global organization. Not only this, after this the ICC explained to the PCB in 10 points what sanctions and how much loss it would have to face if it does not play this match.

After ICC's reply, PCB lost its arrogance and started talking to an ICC official through the back door. It is expected that the conditions will become clear by Sunday morning.

The PCB had tried to distance itself from the situation by putting all the responsibility on the Pakistani government for not playing the match with India. The ICC has asked the PCB that how can the decision to withdraw from just one match be justified when the team is ready to play the remaining matches of the entire tournament under the instructions of the government.

A few days ago, the PCB had officially written an email to the ICC demanding the imposition of force majeure provisions. In this, reference was made to the internet media post of the Pakistan government in which the team was instructed to stay away from the match against India in Colombo on 15 February.

According to an ICC director, the PCB has approached the ICC to discuss the issue. The ICC believes that the interests of the game must prevail over any unilateral action. Force majeure is a legal provision that allows a party to shirk its responsibilities under extraordinary circumstances. This includes situations like war, natural disasters, government orders or public emergency.

Its use is valid only if the affected party proves that the incident was unexpected and unavoidable. He made all possible efforts to minimize the loss. For this, mere inconvenience or political preference is not enough.

The Pakistan government had earlier announced that the team would not participate in the match against India only to support Bangladesh. Bangladesh had refused to play in India due to security reasons. Pakistan will play the rest of the matches except India. The ICC has asked the PCB what steps it took to handle the situation before deciding not to play the match. Look for alternatives or ask for discounts.

The ICC has informed the PCB about the legal conditions for invoking force majeure, the evidence required to withdraw from a match, and the wider impact it will have on the game, business and management. If the use of force majeure is found illegal, the ICC could also demand possible damages.

The ICC also said that playing only a few matches is against the basic principle of a global tournament. This could lead to PCB breach of contract and disciplinary action under the rules. The ICC had held extensive discussions with Pakistan over several days following the same procedure followed in the case of Bangladesh.
