Jagran correspondent, Udaipur. In the SC-ST Act case registered for changing the name of a road after a historical personality in Rajsamand, the Rajasthan High Court has strongly commented on the role of the police and the complainant.

Justice Farzand Ali of Jodhpur Bench said that the legal powers granted by the Constitution will not be allowed to be used as a tool to harass anyone. The court termed the police investigation as an “embellished story” and expressed fear of misuse of the law.

The case took a dramatic turn during the hearing on January 28, when a video clip was played in the court. It was clearly seen in the video that the complainant, who had registered the case under the SC-ST Act, was beating the alleged accused with kicks and punches.

As soon as this 'live evidence' came to light, the police officer who was adamant on arresting the accused had to change his stance. This petition was filed on behalf of Bharat Kumar Dave.

The court said that the police conducted a one-sided investigation by selecting facts. The representation given earlier by the petitioner was merely appended to the file and no actual action was taken on it, which shows bias.

The court raised the question as to why the person opposing the road naming would use caste abuses against the Municipal Council's Jamadar, when he had no official connection with the decision.

When two FIRs were found related to the same incident, the High Court has ordered their joint investigation. Also, instructions have been given to conduct an impartial investigation under the supervision of a senior officer and put a stay on the arrest of the accused till 16th February.

Rajasthan BJP MLA Balmukudancharya on Friday once again demanded to control the loud sound of loudspeakers installed in mosques and madrassas. He further said that when our prayers or satsangs take place, the administration gives orders to switch off the mike at 10 pm, but the loud loudspeaker playing is not being controlled by the Muslim community. Children suffer from studies due to loud loudspeakers. Sick people have problems. It is known that Balmukundacharya had also raised this issue in the Assembly on Thursday.

Rajasthan High Court strict on brutal assault in police custody and false NDPS case

Rajasthan High Court Jodhpur Main Bench has shown strictness on the serious allegations of brutally assaulting a person during police custody in Pratapgarh and implicating a person in a false NDPS case. After the rebuke of the High Court, Pratapgarh SP has suspended the accused Police Inspector and the then SHO Deepak Banjara with immediate effect. Also, instructions have been given to continue the independent and impartial judicial investigation of the case.

Seeing the seriousness of the case, the court of Justice Farzand Ali directed the Judicial Magistrate of Pratapgarh to proceed with the investigation without any pressure.

Senior advocate Dhirendra Singh and advocate Rabin Singh appeared on behalf of the victim. After seeing the photographs of the victim's injuries, the court had termed the behavior of the police as 'animal-like'. This petition is of 34-year-old Shakir Sheikh, resident of Pratapgarh.

It is alleged that SHO Deepak Banjara and his team detained Shakir's father Abdul Hameed Shaikh, forcibly entered the house, tortured him brutally and fabricated fake evidence to implicate him in a false NDPS case.

According to the allegations, the police tried to attract serious charges under Section 59 of the NDPS Act and BNS, which could lead to a punishment of more than 10 years.

651 quintal churma prasad served to more than four lakh devotees in Rajasthan

Apart from Rajasthan, a large number of devotees from Haryana, Delhi and Uttar Pradesh also reached the fair.
