Gangster Abu Salem will not be released from jail

Digital Desk, New Delhi. Gangster Abu Salem will have to remain in jail for now. The Supreme Court on Monday refused to consider his petition. The apex court has asked Salem to approach the Bombay High Court for hearing and disposal of this case. In the petition, Salem claimed that he has been illegally detained for more than 10 months even though he has already completed the 25-year sentence awarded to him in the 1993 Mumbai blasts case.

Salem, convicted in the 1993 Mumbai blasts, was extradited from Portugal on November 11, 2005, after a protracted legal battle. As per the terms of the extradition agreement between India and Portugal, Salem cannot be given the death penalty and his imprisonment cannot exceed 25 years.

A bench of Justices Vikram Nath and Sandeep Mehta was hearing Salem's plea challenging the Bombay High Court's July 2025 order that the period of 25 years had not yet been completed.

Salem had filed a petition in the High Court seeking his release, claiming that he had already served 25 years of imprisonment, including remission for good behaviour. The High Court had accepted his petition, but refused to grant any interim relief.

During the hearing on Monday, the Supreme Court told Salem's lawyer that the High Court has refused to grant him only interim relief. The bench said, go and argue the matter (before the High Court).

When the lawyer said that the parties concerned have already filed their affidavits before the High Court on his petition, the bench said, the High Court will take a decision after considering the affidavits. Salem is convicted under TADA (Terrorist and Disruptive Activities Prevention Act).

The bench dismissed the petition as withdrawn and gave liberty to Salem to approach the High Court for speedy hearing and disposal of the pending case.
