Strict Order From Allahabad High Court, 'Take Decision On Seniority Of 172 Constables Of 2015 Batch Within Two Months'

Allahabad High Court has directed Additional Director General of Police (ADGP) Personnel Lucknow to take a decision in two months in the matter of seniority of 172 constables of Uttar Pradesh Police Recruitment 2015 batch. Justice Vikas Wednesday has given this order on the petition of Vivek Kumar Tripathi and 171 others.

26 days were reduced in determining seniority

On behalf of the petitioners, it was said that a reduction of 26 days has been made in determining their seniority, which is contrary to the service rules. The petitioner constables had registered themselves in the police lines for JTC (Joining Training Course) on 02 December 2015. In the records of the department, his joining date is recorded as 28 December 2015.

Crisis regarding his promotion in future

Due to this difference of just 26 days, these constables have become junior to other personnel of their own batch. This has created a crisis regarding their promotion in future. Everyone was first called to Gorakhpur. Here, male constables from petition number 1 to 169 were sent to Deoria while four female constables were sent to Shahjahanpur.

Receipt of money deposited in mess becomes evidence

Advocate Shailja Kant Tripathi of the petitioners argued in the court that at the time of arrival, Rs 3,000 each had been deposited as advance mess fee. The court said that when the soldiers were present in the police line and the mess receipts were being deducted, then it is wrong to show late joining in the records. It also came to light that Gorakhpur SP (South) had accepted the mistake of the department in his investigation report on 24 April 2023 itself. Despite this, the police headquarters did not correct the records.

Court said- take decision within two months

The court has asked the petitioners to submit a comprehensive report before the ADGP by 20 February 2026. ADGP should decide the petitioner's claim within two months on the basis of the report dated 24 April 2023.
