Dialogue Associate, Deoband (Saharanpur). Jamiat Ulama-e-Hind chief Maulana Mahmood Madani has termed the Supreme Court's direction to the petitioners to approach the High Court in the case of Assam Chief Minister Himanta Biswa Sarma's hateful and provocative acts against a particular community as disappointing. He said that this decision of the Supreme Court is extremely disappointing for the justice loving people.
In a statement issued on Tuesday, Maulana Mahmood Madani said that under Article 32 of the Constitution of India, citizens have the right to directly approach the Supreme Court for the protection of their fundamental rights. The Supreme Court is expected to take strict and clear steps in cases related to hate speech, communalism and right to life of any section.
Madani also said that when a case of hate act against a Chief Minister is directly brought to the Supreme Court and the Court calls it a weak case by linking it to electoral politics, then it is natural that a question arises in the minds of the public whether our judicial system is bowing before the government.
He said that such sentiment not only promotes despair but also has a negative impact on the reputation of the court. Jamiat respects the judiciary, but cases of hate speech and communalism require seriousness and speedy justice. Madani also told that Jamiat will approach the High Court in this matter.
