State Bureau, Patna. A high-level brief training session related to the process of disciplinary action was organized on Thursday in the auditorium located at the Old Secretariat. The objective of this training session is to ensure that the process of disciplinary action in the state is transparent, lawful and fair and that procedural errors are avoided.
This program was presided over by State Chief Secretary Pratyaya Amrit while co-chaired by Director General cum Chief Investigation Commissioner Deepak Kumar Singh. The main topic of the training session was disciplinary action. Deepak Kumar Singh said that a master circular has been issued on this subject by compiling all the circulars issued from time to time by the General Administration Department.
Also, a book has been compiled collecting Article 311 of the Constitution and other relevant provisions and important decisions of the High Court and Supreme Court related to disciplinary action. So that, a holistic and clear understanding of the action and procedure in disciplinary matters can be developed.
During the session, special emphasis was laid on the fact that it is necessary to follow correct terminology and legal procedure at the time of any investigation. In this context, the need to avoid some common errors was discussed, which include giving small punishment directly without framing charge sheet, seeking opinion from the disciplinary authority or administrative department on the defense statement of the accused officer and issuing orders regarding the quantum of punishment, allowances payable during the period of suspension and adjustment of the period of suspension in a single resolution.
It was clarified that in the cases of level-9 and above officials, consultation with Bihar Public Service Commission is mandatory before issuing the sentence. Development Commissioner Mihir Kumar Singh, Revenue Council Chairperson Harjot Kaur Bamhra, Additional Chief Secretary of General Administration Dr. B. were present in the session. Rajender, Additional Chief Secretary of Home Department Arvind Kumar Chaudhary and other officials were present.
