The court of Additional Sessions Judge at Tis Hazari has reserved its order on the bail plea of ​​eight accused arrested in the stone pelting incident that took place during the demolition campaign near Turkman Gate. The court of Additional Sessions Judge Bhupinder Singh will pronounce the verdict in the case on February 12. At the same time, the arguments related to the other four accused in the case will also be heard in the court on Thursday.

The eight accused on whose bail the decision has been reserved include Mohammad Adnan, Mohammad Kaif, Mohammad Kashif, Sameer Hussain, Mohammad Ubaidullah, Mohammad Arib, Mohammad Naved and Mohammad Athar. The other four accused are Adnan, Mohammad Imran, Aamir Hamza and Mohammad Adil.

On Monday, the court heard arguments on behalf of Mohammad Adnan. The defense raised questions on the process of arrest, saying that the initial FIR did not contain Section 109 (attempt to murder) of the BNS and the offenses charged were bailable. The defense claims that there is no concrete evidence against Adnan for his involvement in violence.

The advocate alleged that Adnan's mother and sister were locked in the room at the time of the arrest, there was no female policeman in the team and the arrest memo was forcibly signed by an acquaintance instead of a family member. Adnan was also accused of custodial assault.

On January 13, the magistrate had ordered a new MLC after injury marks were found on the body of co-accused Mohammad Imran in the case. No external injury was found on Adnan's body. However he complained of physical pain. The defense also argued that the CCTV cameras at the police post where the two were caught were malfunctioning.

Public Prosecutor Atul Srivastava opposed the defense's claims and said that information about the addition of Section 109 was given through the arrest memo. The defense also demanded bail on the basis of equality and said that co-accused Ubaidullah has already got bail from the sessions court. This case is related to the violence that took place during the removal of encroachment near Faiz-e-Ilahi Mosque in Ramlila Maidan area on the night of January 6.
