Supreme Court Gives Relief To Cardiologist In Medical Negligence Case, Accused Of Death Of Two Patients For PMJYE Benefits

Digital Desk, New Delhi. The Supreme Court has refused to cancel the bail granted to a cardiologist from Gujarat accused in a serious case of medical negligence. Also said that while giving relief to the accused doctor, he said that he should be allowed to serve.

This cardiologist is accused of conspiring to take advantage of 'Ayushman Bharat-Pradhan Mantri Jan Arogya Yojana' (PMJYE) by performing unnecessary and wrong angioplasty operation on two beneficiaries, leading to the death of both the patients. The cardiologist was arrested on this charge.

Supreme Court rejected Gujarat government's petition

A bench of Justices JK Maheshwari and AS Chandurkar on Monday, February 9, rejected the Gujarat government's plea challenging the regular bail granted by the High Court to cardiologist Dr Prashant Vazirani on December 8 last year.

The bench told lawyer Swati Ghildiyal, appearing for the Gujarat government, 'He is a doctor, a cardiologist, let him serve as a doctor. You can keep an eye on them. If he is doing something wrong, you can take action.

On this, the Gujarat government said that this is a serious matter and two people have lost their lives due to unnecessary operations done by the doctor. In response, Justice Maheshwari said, 'We have seen all the material. We will not interfere.

The Supreme Court also asked senior advocate Ranjit Kumar, appearing on behalf of the doctor, why he was doing all this. You are a cardiologist, why are you getting involved in all this?

On December 8 last year, the High Court had granted bail to Vazirani, who had performed angioplasty on the victims at Khyati Multispeciality Hospital in Ahmedabad.

This is how two patients lost their lives

According to the police, the victims were operated upon and stents were placed only to avail the benefits of the PMJAY scheme, as the government would pay the hospital for the surgeries performed on the beneficiaries of the scheme.

Ayushman Bharat-PMJAY provides free health insurance up to Rs 5 lakh per year to the needy people. Nagarbhai Senma (59) and Mahesh Barot (45) were among the seven persons who underwent angioplasty with stent placement at the Ahmedabad hospital. Both these residents of Mehsana district of Gujarat died in the hospital on the same day.

On November 14, 2024, the police registered three FIRs in connection with the death of two PMJAY beneficiaries due to unnecessary and wrong angioplasty operation and arrested Vazirani, who had performed the heart procedure.

Vastrapur police of the city registered the case and arrested the accused doctor. Two cases came on complaints from relatives of the deceased, while the third case was registered by the Chief District Medical Officer after the state government approached the police.
