Update On Jharkhand Civic Elections; Now Assistant Returning Officer Will Not Be Able To Scrutinize Nomination Papers

Scrutiny of nomination papers will not be done by Assistant Returning Officers (AROs).

Neeraj Ambastha, Ranchi. During the civic elections to be held in the state, only the Returning Officer (RO) will scrutinize the nomination papers filed by the candidates. Scrutiny of nomination papers will not be done by Assistant Returning Officers (AROs).

The State Election Commission has given strict instructions to the election officials regarding this. However, nomination papers can also be presented by the candidates before the Assistant Returning Officer.

According to the Commission, scrutiny of nomination papers of candidates is a quasi-judicial process. Therefore this work will be done only by the returning officer. Guidance should not be sought from any senior official or observer in the scrutiny of nomination papers.

The decision has to be taken by the returning officer only. According to the Commission, at the time of scrutiny of nomination papers, candidates, their proposers, election agents and one other authorized person or advocate can be present.

Candidate's presence will not be mandatory at this time. All nomination papers filed by the candidates will be scrutinized by the returning officer on the date and period prescribed.

Election officials have been asked to do a preliminary check of the nomination papers at the time of submission by the candidate, such as whether the name of the candidate and his proposer is in the voter list or not and whether the necessary documents have been attached with the nomination paper or not.

Therefore, the returning officer should have the voter list of all the wards of the entire municipality, because a person recorded in the voter list of the municipality can be a candidate from any ward.

The Commission has asked to complete all the processes related to filing of nomination papers as per the guidelines issued earlier. It has been asked to ensure that only a maximum of three vehicles and five persons enter while filing nomination papers.

At the time of nomination of a candidate, only three vehicles will be allowed to enter the 100 meter radius of the Returning Officer's office. At the same time, at the time of enrolment, only a maximum of five people will be able to enter this perimeter.

Nomination will not be canceled on the basis of technical and clerical error

It has also been suggested to the election officials that technical and clerical errors should be ignored while scrutinizing the nomination papers. Nomination of any candidate should not be canceled on that basis.

Also, there should be sufficient grounds for cancellation of nomination of a candidate. The guidelines of the Commission related to this should be strictly followed.
