Agarwal Nursing Home And The New India Insurance Company Fined ₹ 23.60 Lakh For Negligence In Maternity Operation

Jagran correspondent, Shamli. The District Consumer Disputes Redressal Commission held Agarwal Nursing Home guilty of gross negligence during the operation. After this, the opposition nursing home and the New India Insurance Company have been jointly ordered to pay Rs 23 lakh 60 thousand to the victim.

Kairana resident Shaili's wife Ankit Sharma had filed a case in the District Consumer Disputes Redressal Commission on 26 November 2021. In this, Shaili told that she had gone with her husband to Bohra Nursing Home for ultrasound on 31 August 2021. The doctor told that it was time for delivery and one should go to a good maternal and child center and get the delivery done. The same day he met Dr. Manju Agarwal, the operator of Agarwal Nursing Home.

Citing that the child's condition was not good, he asked for immediate operation. The operation was done under the supervision of a doctor. The fee for this was fixed at Rs 60 thousand. After the operation, she gave birth to a daughter, but her condition started deteriorating from the very next day. Gave him medicine and asked him to rest.

On the advice of doctor sister Charu Sharma, she got a CT scan done, on which the nursing home staff treated her rudely and forcibly threw her out. The opposition party, after recovering additional Rs 2 lakh, barely made a referral slip but refused to provide the case history. When the victim was taken to Jaipur Golden Hospital in Delhi in a critical condition, the doctors there found in the CCT test that her intestine was carelessly cut during the operation, which led to a serious stomach infection.

Shaili remained hospitalized for two months. Due to negligence, the victim is still in bed and has a tube and bag fitted for defecation. Considering the seriousness of the matter, Commission Chairman Hemant Kumar, in the presence of members Amarjeet Kaur and Abhinav Aggarwal, admitted that the opposition not only made an error in the operation, but also endangered the life of the victim by not providing proper care thereafter.

The Commission clarified that Rs 18 lakh 50 thousand should be given to the victim for her treatment expenses. At the same time, the compensation for being deprived of the joy of motherhood should be Rs 2 lakh for the mother and newborn, Rs 3 lakh for mental and physical suffering and Rs 10 thousand as litigation expenses.

The Commission clarified that out of the total amount, Rs 5 lakh will be borne by the insurance company and the remaining amount will be given by the opposition Agarwal Nursing Home near MSG Road Gurudwara. It warned that if the amount is not deposited within 45 days, action will be taken under the Consumer Protection Act.
