Allahabad High Court has given an important order in the case of making false promises of marriage for physical relations.
Law correspondent, Jagran, Prayagraj. Allahabad High Court said that the tendency of reneging after sexual intercourse by giving false promise of marriage is increasing in the society and it needs to be nipped in the bud. Justice Nalin Kumar Srivastava has made this comment while rejecting the anticipatory bail application of Auraiya resident Prashant Pal.
According to the prosecution, despite a relationship of five years, the accused refused to marry the victim and got engaged to another woman. Appellant's counsel said, both (appellant-victim) are adults and have been living together in a consensual relationship since 2020, but the accused had never made any promise of marriage. Merely refusing to marry is not a crime.
Opposing the application, the state government said that the medical examination has confirmed the statement of having sexual relations with the victim. The accused was also threatening the victim with obscene videos. After hearing the arguments of both the parties, citing various decisions of the Supreme Court, the court said, the facts show that the accused had the intention of deceiving the victim from the very beginning. He was just fulfilling his lust. This is a serious crime against the society.
Although the victim was an adult and aware of the consequences, she completely trusted the accused. A case has been registered against the accused in Auraiya police station, district Auraiya under various sections of BNS.
