Mukesh Thakur, West Delhi. In Delhi, the main contractor accused of negligence in the case of death of youth Kamal Dhyani after he fell into an open pit of Delhi Jal Board in Janakpuri area of West Delhi late on February 5 is now in hiding to avoid the clutches of the law.
West Delhi Police, during the hearing before the Metropolitan Magistrate of Dwarka District Court on Thursday, officially informed that the accused, Himanshu Gupta and Kavish Gupta, both the main contractors of KK Spun India Limited, are currently absconding.
Demand to issue warrant
Police told the court that both the accused have gone underground after their anticipatory bail pleas were canceled by the Sessions Court on February 18 and the Delhi High Court on Wednesday. During this, victim Kamal's lawyers Aastha Chaturvedi and Pooja Sharma demanded from the court the immediate arrest of both the accused and issuance of non-bailable (NBW) warrants against them, so that both of them can be arrested and interrogated.
It is noteworthy that this accident took place on Janakpuri Jogender Singh Marg, when a young man named Kamal Dhyani died after falling into a deep and unsafe pit dug for water board work on the road. In this case, the police had registered a case of negligence after investigation.
At the same time, during the initial action, the police had arrested sub-contractor Rajesh Prajapati and one of his employees associated with this project. During the custodial interrogation of the police, it became clear that the main contractors are equally responsible for ignoring the safety standards.
Order for custodial interrogation of the accused
After this accident, Himanshu Gupta and Kavish Gupta had resorted to legal tactics to avoid arrest. Initially, he had got anticipatory bail from the lower court, but considering the seriousness of the case, his anticipatory bail was later canceled in the hearing held on February 18 and custodial interrogation of the accused has been ordered for fair investigation of the case and to bring out the truth. After this order, both of them had to appear before the police investigating officer but they absconded.
After this the accused approached the Delhi High Court, but they did not get any relief from there also. The High Court on Wednesday rejected his anticipatory bail plea outright and upheld the lower court order.
No trace of either was found
During the hearing in Dwarka court, the investigating officer said that after the court order, both the accused were given notices several times to join the investigation, but they deliberately remained absent. In the last few days, the police team has conducted extensive raids at their homes, corporate offices and many possible hideouts in Delhi and surrounding areas, but no trace of the two has been found.

The police have assured the court that continuous efforts are being made to arrest the accused and they will soon be brought before the law.
The accused are not only contractors but also directors of the company.
Both of them are not only contractors but also directors of the company carrying out the work in Janakpuri. However, in the recent hearing held in the Sessions Court, the lawyer of the accused had told the court that Himanshu Gupta and Kavish Gupta were members of the KK Spun India Limited company which had got the main contract of this project from the Delhi Jal Board. Both have resigned from the post of its directors.
According to sources, the main objective behind leaving the post was to ensure that other government contracts awarded to the company in future are not affected and the company can be saved from being blacklisted.
