Law correspondent, Jagran, Prayagraj. Allahabad High Court has given relief to former Mahoba SP Manilal Patidar. The court has stayed the proceedings and summoning order of the case going on against him in the special court of Lucknow. The court has sought a reply from the state government in this matter within two weeks. This order has been given by Justice Sanjay Kumar Pachauri.
Manilal has filed a petition challenging the cognizance and summons order issued by the Special Court for Prevention of Corruption, Lucknow. His advocate said that the petitioner has been implicated in a false case just to harass him. The court has issued the summons order without considering the facts of the case.
No court can take cognizance of a case registered under section 172/188 of the IPC unless a written complaint is made by a public authority or a higher officer concerned. Considering the prima facie case as a matter for consideration, the court has directed the state government to file its reply within two weeks. The proceedings of the case have been stayed till the next hearing.
Mahoba crusher businessman Indrakant Tripathi had made serious allegations against former SP Manilal Patidar of demanding bribe and threatening to kill. On September 8, 2020, Indrakant was shot under suspicious circumstances. He released the video and accused Patidar of conspiracy to commit murder. He died three days later.
After this, Indrakant's brother had filed a case against Patidar, then Inspector Kabrai Devendra and other police personnel. On July 22, 2021, a case was registered against Patidar in Mahoba Kotwali police station in the corruption case.
