The hearing on the PIL filed in the Himachal Pradesh High Court against increasing the tenure of the Mayor of Municipal Corporation Shimla to five years has been postponed to December 30. It was told by the government that the ordinance brought to extend the tenure of the Mayor was placed before the Assembly and it has been passed by the Assembly. The government has said that in the current circumstances this writ petition is no longer valid. On this, it was told on behalf of petitioner Anjali Soni Verma that the amendment passed by the Assembly has not yet received the approval of the Governor, hence the situation has not changed. After this, the defendants demanded additional time to respond to the petition, accepting which the court has issued orders to schedule the next hearing on December 30. In the same case, councilors Asha Sharma, Kamlesh Mehta and Saroj Thakur had applied to be made plaintiffs as petitioners, which was accepted by the court.

Three defendants have been made

The petition was heard before a division bench of Chief Justice Gurmeet Singh Sandhawalia and Justice Zia Lal Bhardwaj. The ordinance brought by the government in this regard has been challenged through Public Interest Litigation. Advocate Anjali Soni Verma, challenging the government's decision, has made the State Election Commission and Mayor Surendra Chauhan along with the Urban Department of the State Government as defendants.

Allegation of bringing ordinance for a particular person

The petitioner alleges that the state government brought the ordinance with the intention of providing illegal benefit to a particular person. The applicant says that the ordinance is brought in emergency circumstances.

Women should have got a chance to be selected

At the end of the tenure of the current mayor, an eligible woman should have been given a chance to be selected for the post of mayor. It has been alleged that the government has misused its powers to violate the constitutional rights of women, hence this ordinance should be repealed.
