The Municipal Council has received a big blow from the High Court in the ongoing dispute regarding the ownership rights of valuable land situated on Nainital Road of the city. Rejecting the claim of the municipality, the court ruled in favor of the opposition farmers and ordered the municipality not to interfere in the land in any way.
There was a dispute going on for a long time regarding the area of Gata numbers 263 and 264. The municipality argued that these are kiln pits, which are the property of the municipality because they are lodged in the pond. At the same time, six tenants including Jamil Ahmed were claiming ownership by calling it ancestral property.
Recently, the farmers had started construction of a market on the land, which was stopped by the Municipality with the help of the Revenue Department by registering an objection and claiming ownership by filing a writ in the High Court.
In its order, the High Court has rejected the claim of the municipality and has banned any kind of interference, disruption or intervention by the municipality on the land of the concerned Gata number. Executive Officer Shashi Prabha Chaudhary said that legal opinion is being taken in the matter, further action will be informed soon.
