Jagran correspondent, East Delhi. The Motor Accident Claims Tribunal (MACT) located at Karkardooma Court in Delhi has ordered a compensation of Rs 83.89 lakh to the family of UP Police constable Rohit Kumar, who died in a road accident. The accident occurred in Meerut in the year 2021.

The tribunal held that the accident occurred due to the negligence of the accused bike rider and driving in the wrong direction. Presiding Officer Vijay Kumar was hearing the claim petition filed by the family of deceased Rohit Kumar.

According to records, the accident took place near Fugana Gate village on Shamli Road, Meerut, when Rohit Kumar's motorcycle was hit by another bike coming from the front. The collision was so severe that he suffered fatal injuries and died.

In the order, the tribunal said that the petitioners have proved that the accident occurred due to rash and negligent driving by the accused bike rider. The tribunal specifically noted that the accused driver was riding the bike in the wrong direction, resulting in a head-on collision.

“Driving on the wrong side of the road is inherently a serious and reckless act unless there is a justifiable reason for doing so, and no such justification has been found in the present case,” the tribunal said in the order. The tribunal also noted that Rohit Kumar was 28 years of age at the time of the accident and was working as a permanent employee in the Uttar Pradesh Police.

The tribunal calculated the compensation by adding 50 per cent increase to his income, taking into account the possibility of permanent employment and future income growth.
