New Delhi, PTI. The Supreme Court allowed Ashish Mishra, an accused in the 2021 Lakhimpur Kheri violence case, to go home to spend time with his daughter between December 25 and 31, ahead of her Class 12 board exams. Ashish is the son of former Union Minister Ajay Mishra. Earlier on October 9, the Supreme Court had allowed Ashish Mishra to go to his hometown Lakhimpur Kheri to celebrate Diwali with his family.
A bench of Chief Justice Surya Kant and Justice Joymalya Bagchi considered the petition filed by senior advocate Siddharth Dave on behalf of Mishra. During this time, instructions were given to keep the bail conditions given earlier in force, which also includes the condition of not participating in political activities. During the hearing, the Chief Justice took note of the status of the ongoing case against Mishra and others.
The bench was told that till now the testimony of 36 witnesses has been taken, while the testimony of 85 witnesses is still pending. Similarly, in the case related to the second FIR, testimony of 35 witnesses is still pending. The Additional Advocate General of Uttar Pradesh told the bench that 789 cases were pending before the judge hearing the case. The bench said that various special courts are facing excessive burden.
The matter will be heard as a whole in March 2026. On October 3, 2021, farmer leaders had protested in Tikunia of Lakhimpur Kheri district against the visit of Deputy Chief Minister Keshav Prasad Maurya to the area. Eight people died in the violence during this period, out of which four were farmers. Four farmers were crushed by a car. After this, angry farmers thrashed a driver and two BJP workers to death. A journalist also died in the violence. In December 2023, the trial court had framed charges against Mishra and 12 others under charges of murder of farmers, criminal conspiracy and other penal laws.
